NEW YORK — A Bronx woman who suffered catastrophic injuries when a commercial vehicle struck her car has reached a $2.5 million pre-trial settlement, her attorneys announced. The settlement, obtained by trial attorney Philip Monier of David Resnick & Associates, P.C., resolves a lawsuit filed in the Supreme Court of the State of New York, Bronx County.
The 43-year-old woman, who worked as an occupational therapy assistant before the crash, sustained a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures. She also suffered herniations and protrusions at multiple levels of her spine, along with nerve damage, leaving her permanently disabled and unable to work, according to the law firm.
“The physical toll of the crash was devastating, requiring our client to undergo major surgical intervention and face an incredibly challenging road to recovery,” Monier said in a statement.
The accident has had far-reaching consequences beyond her career. The woman’s injuries limited her ability to perform daily activities that many take for granted, including walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores, the firm stated.
Monier noted that the settlement provides “financial peace of mind” to help cover ongoing medical care, specialized rehabilitation, and long-term support. “We are incredibly pleased to have secured this settlement for our client, whose life was completely turned upside down by this crash,” he added.
The case was notable because the defense planned to argue that the woman’s injuries were pre-existing and not caused by the crash, or that they had fully healed. However, David Resnick & Associates was prepared to counter that the accident was a substantial factor in causing her injuries, and that any pre-existing conditions were worsened by the collision. The firm also intended to demonstrate that the woman remained permanently disabled and would require ongoing treatment and future surgical care.
This settlement is one of several recent successes for Monier. In June 2026, he secured a $1.925 million settlement for a client injured in a staircase slip and fall, and in July 2026, he obtained a $1.3 million settlement for a client who suffered catastrophic injuries in a fall outside an elevator.
